Dear Counsel: Now that we have had an opportunity to review the documents you produced and your responses to our discovery requests, I am writing to you about your classification of documents, asking that you reclassify certain types of documents. As you know, the Protective Order requires that nothing shall be designated as for "Attorneys' Eyes Only" except information of the most sensitive nature that, if disclosed to persons of expertise in the relevant area of knowledge would reveal significant technical or business advantages or disadvantages of the producing party. (see P9 of the Protective Order). Your production includes documents classified as attorneys' eyes only that do not rise to this high level of sensitivity. You designated, for example, an email between Eric Edwards and Katherine Jansen discussing the "word in the street" about FundsXpress (DIN102054). You also designated as attorneys' eyes only the email message on November 12, 2001 from Giff Dunn to Eric Edwards forwarding FundsXpress's pricing suite and Edwards's reply (DIN101885). This document has already been made public in the Kansas litigation against Mr. Dunn and is quoted verbatim in FundsXpress's complaints. Neither of these documents reveals significant technical or business advantages or disadvantages of Digital Insight. Other emails such as DIN101425 are transmittals of public press releases by Digital Insight, FundsXpress or other banking service providers. Certainly nothing in the transmission by email of a document intended to be made public is sensitive enough to warrant designation as attorneys' eyes only. We ask you to redesignate as confidential all Digital Insight emails listed in Exhibit A to this letter. In addition, we are asking that you reclassify as confidential rather than attorneys eyes only the following documents listed in Exhibit B to this letter. These documents do not convey information that an expert could interpret in order to achieve significant technical or business advantages over Digital Insight: We are also asking that you reclassify FundsXpress documents that you have produced to us.
