BE IT REMEMBERED on the 6th day of January 2003 the Court called the
above-styled cause for status conference, and the parties appeared
through counsel of record. The Court confirms its oral announcements
at the hearing with the following written orders:

IT IS ORDERED that the Plaintiff's Motion for Leave to File
Plaintiff's Fourth Amended Complaint [#68] is GRANTED, and the Clerk
of the Court SHALL FILE Plaintiff's Fourth Amended Complaint on this
date;

IT IS FURTHER ORDERED that the Defendant's Motion to Quash Notice of
Deposition by Written Questions and for Protective Order [#62] is
DISMISSED AS MOOT per the Defendant's announcement at the hearing that
the motion is withdrawn.
